B U L L E T I N Subject: SB 777 New Whistleblower Protections SB 777 will become effective January 1, 2004: This bill extends Whistleblower protections to employees who report a violation of a state or federal rule, who refuse to participate in an activity that would result in a violation of a state or federal rule, statute, or a violation or non-compliance with a state or federal rule or regulation, or who exercised these rights in former employment. The bill requires the establishment of a “whistleblower hotline” within the office of the Attorney General. The bill amends section 1102.5 of the Labor Code. It makes it unlawful for an employer to retaliate against an employee who exercises his or her rights or in any former employment. An employer that is a corporation or limited liability company is liable for a civil penalty not exceeding $10,000 for each violation of this section. The bill requires an employer to “prominently display in lettering larger than 14 pica type a list of the employee’s rights and responsibilities under the whistleblower laws, including the telephone number of the whistleblower hotline described in section 1102.7.” A fair amount of time and effort was expended in attempting to locate the “whistleblower hotline” number at the Attorney General’s Office. For now, the number will be the same as the AG’s Public Inquiry Unit regular number, which is: 1-800-952-5225.
