New Dust Rules in Coachella Valley WE HAVE LEARNED THAT ENFORCEMENT OF NEW DUST PROVISIONS HAS BEGUN IN THE COACHELLA VALLEY: A previous memo indicated the new rules would become effective April 1, 2004. We have learned that enforcement is currently underway. The Coachella Valley Particulate Matter Implementation Plan contains a provision that a person certified in dust control (Environmental Observer) must be present at construction sites of 50 acres and larger in the Coachella Valley. Most City Councils in the Valley have already passed ordinances that adopt the “memorandum of understanding (between SCAQMD and Cities in the Coachella Valley) establishing an ongoing multi-jurisdictional relationship for the adoption, implementation, and enforcement of fugitive dust measures in the Coachella Valley.” SCAQMD is expected to amend its Rule 403.1 in April, 2004 to require areas not covered by City Ordinances to comply. City inspectors trained by SCAQMD as well as SCAQMD enforcement personnel will be vigorously enforcing the new rule. To have your company’s SCAQMD Dust Control Plan approved it must be signed by someone who has attended the class and been certified as an “Environmental Observer.” SCAQMD conducts 3-4 hour dust control classes monthly at no cost.
